About Permanent Workers in the United States

Each year, the United States government welcomes 140,000 immigrants, and their spouses and children, into our country based on their employment. There are a few different categories these workers fit into, depending on their job skills and a few other factors.

  • EB-1: Priority workers, also called first preference workers, includes individuals with extraordinary abilities that make their job skills extremely valuable to the United States. This may include individuals with gifts in the sciences, arts, education, business, or athletic skills. This category also includes outstanding professors, researchers, and multinational executives and managers.
  • EB-2: The second preference of workers includes individuals with advanced degrees or exceptional abilities in their respective fields.
  • EB-3: Individuals who fall under the third preference are also skilled workers, usually in more common professions, but with qualifications similar to those in EB-2.
  • EB-4: EB-4 immigrants can fall under several categories, including religious workers, employees of U.S. foreign service posts and retired employees of international organizations. This may also include children from other countries who are wards of the courts in the United States.
  • EB-5: The immigrants permitted to enter the U.S. under EB-5 must invest $500,000 towards a targeted employment area, or $1 million in any new commercial enterprise that employs at least 10 people. The employees must be full-time, U.S. workers.

The PERM Process

In order to obtain a permanent residence card for employment purposes, you need to go through the PERM process. You must first file a Form I-140 or a Petition for Alien Worker. Or, if you are entering as a professor or researcher, your employer must fill out the Form I-140. If you are a multinational manager or executive, your employer must fill out the USCIS Form I-140.

If you have immediate family members who will be coming with you to the United States, you must also follow the appropriate application process for them as well. Spouses and children under the age of 21 may file for E-21 and E-22 immigration status, respectively, and your spouse may also file an Employment Authorization Document. In some cases, spouses of skilled workers or professionals will need to file E34 or EW4, and the minor children of skilled workers will file under either E35 or EW5.
