Understanding Your Immigration Rights in the U.S.

Although the first two months of the Trump presidency have been filled with confusion and unpredictability, and even hostility toward immigrant communities, one thing is certain - now more than ever it is important to know your rights. Everyone living in the United States has certain rights protected under the United States Constitution, including undocumented immigrants.

The American Immigration Lawyers Association (AILA) is an organization committed to helping immigrants. The attorneys at Milla & Associates, LLC are experienced immigration attorneys and members of AILA, providing comprehensive immigration services, including removal (“deportation”) defense, Deferred Action for Childhood Arrivals (DACA), asylum, U visas, provisional waivers and other hardship waivers, applications for permanent resident status (“green card”), and citizenship.

AILA has created “Know Your Rights” flyers to provide crucial information in the event of an encounter with ICE officers at home, at work, or in a public place. We understand how frightening the thought of an encounter with ICE can be, not to mention an actual encounter. Therefore, it is very important to know how to handle such a situation before it happens.

You do have rights. Please print and read the AILA flyers, and contact Milla & Associates if you want to learn more about your rights and possible eligibility for immigration benefits and relief.

Understanding the Provisional Waiver for Unlawful Presence

March 4, 2013 marked the first day that immigrant visa applicants could file provisional waivers for unlawful presence. Under the prior procedure, individuals had to leave the U.S. before applying for the waiver, thus living abroad (and likely apart) from U.S. citizen family. Although the process just started in March, and we are waiting to see how the system is fully implemented, there is cause for optimism.

  • Would have been lost without them!

“Fantastic firm and most notably my wonderful attorney Justin Hoefflicker. He was clear and easy to understand, helpful and able to think outside the box to answer our questions and various what if scenarios. We would have been lost without him deciphering the response letters from the USCIS. Thank you Justin!”

  • We strongly recommend Robert

“My wife and I hired Robert to handle my wife's greencard process while I was busy studying an MBA and could not dedicate much time to the process. We consulted with other lawyers and decided to go with Robert because he was very direct in his answers, gave honest and knowledgeable advice and because from day one he provided first class support and clarity on what the process would be like. My wife benefited greatly from his calmed demeanor and openness to quickly answer our questions and accommodate solutions for our case. We strongly recommend Robert, you will find a lawyer you can trust and that will help and guide your throughout every step of the process.”

  • Highly recommend

“I highly recommend Robert Milla. I was recommended to Mr. Milla by a friend of mine who used him for her permanent residency application as well. Both my husband were touched by the fact that Robert took the time to get to know us during our first meeting with him, before we began the application process. Throughout the process, Robert was very helpful answering any questions we had and educating us on our legal rights. I was a nervous wreck on the day of my permanent residency interview, and Robert put all my fears at ease by assuring me that I had absolutely nothing to worry about. Rest assured, Robert will be my choice as I go to apply for my citizenship in the next few years! Result: Application for adjustment of status to permanent resident (“green card”) approved”

  • Fantastic, down to earth legal counsel who gets the job done!

“After meeting with multiple lawyers, many of whom seemed not to care about the outcome of our case, or left us feeling confused about the process, we finally found Robert. After my initial consultation with him, I left feeling hopeful and assured of the process. My husband is from England, and we had faced many long months apart. With Robert's help, we were finally able to start the process to bring him to the United States. Robert and Daniel were incredibly helpful every step of the way, and never made us feel silly for asking questions. Robert clearly outlined the process for us, so we knew exactly what was happening at each step. Our paperwork was completed in a very timely manner. Incredibly, we had a very short wait for our interview and at that time, Daniel and Robert made sure we were prepared. Robert is extremely trustworthy and tells you exactly how it is, which is so refreshing after being yanked around by other lawyers. My husband received his Legal Permanent Resident card in the mail the other day, and we could not be happier! THANK YOU to Robert and his team for their help! We are so grateful!”

  • The Best Lawyer

“I would like to take this opportunity to thank Atty. Robert Milla, Ms. Sylvia and the rest of the staff of Milla Law firm. The team was of great help in processing my papers and documents, from the application of my Green Card until the application of my U.S. Citizenship. Not to mention how patient Mr. Robert Milla was when answering my questions and paying attention into knotting all the loose ends to make sure that everything goes well for me to achieve the outcome I was aiming for. I would definitely recommend Robert Milla Law Firm not only for his compassion and empathetic demeanor in relating to his clients but also because of his undeniable skills in handling cases in immigration. His assistants are also commendable for being so helpful and attentive. Until now I'm still overwhelmed that I immediately got the schedule of my Oath Taking Ceremony few days after my interview for the application of my U.S. Citizenship. I have no regrets in seeking legal help and advice from this office, and I will definitely hire their service for the petition of my family.”

  • Thank you so much

“I thank God for put Robert on my way. I had a complicated VAWA case due to domestic violence (DV), I had others immigration attorneys opinions where they did not give me much hopes because my short marriage. I got Robert's information from a DV organization, got a free consultation and with not doubt I hired him. He is an excellent attorney, knows what he is doing and how to put your case on the right path. As I mentioned my case was complicated and with God's help, Robert's made it easier. My DV case was approved with no inconvenience and got my interview 6 months after my approval, he prepared me one week before my interview and got me ready for the best and the worst scenario. Thank God in my interview I got approved on the spot and after a week I got my green card. Another important thing is that he is affordable, he has a huge heart and always answered my questions when I had any. I also want to thank his receptionist Sylvia, she was so kind and assisted me during my process after my assistant Maria was gone. If you need an attorney with experience, very reasonable price but with quality and compassion then Robert is the one you need.”

  • We highly recommend Atty Robert Milla and Associates.

“We were married in 2009 and got denied the first time it was filed. We got a lawyer to help us and it took years of waiting and nothing came out of it. Until my wife found Atty Robert Milla on the internet and with his very exceptional and successful work on immigration based cases, we decided to asked him to represent us . He told us what documents we need to re submit to follow up the case and waited for a decision. And finally my wife got her green card before Christmas this year exactly 8 years after we first filed it but Atty Robert Milla was able to get it for us , when we thought it was a hopeless case. We are so happy and very grateful for Atty Robert Milla for all the help and understanding and patience to our never ending questions and also to his paralegal Stylvia . Thank you very much. More power.”
