Understanding Deferred Action for Childhood Arrivals (DACA)

Our Chicago Immigration Attorneys Can Help You Receive And Renew Daca Benefits: (312) 702-1782

Deferred Action for Childhood Arrivals, or DACA, is a federal program initiated in 2012 to provide protection from removal from the United States and employment authorization for certain young undocumented individuals who entered the United State as minors.

While it is important to understand what DACA can do and how it could impact your immigration goals, it is just as important to understand what this federal program cannot do. DACA does not grant anyone a visa status and it is not a permanent benefit. This program does, however, allow eligible applicants to receive a two-year deferral of removal (deportation) and two years of employment authorization where need can be shown. Such benefits can be crucial to individuals dreaming of a day when they can emerge from the shadows and live in the United States without fear of U.S. Immigration and Customs Enforcement ("ICE") and removal (deportation).

With DACA, young persons are able to obtain a work authorization card, Social Security number, and possibly a state driver's license and ID. DACA recipients can seek employment and pursue and/or continue goals for work, school, family, and more. While DACA may not be a long-term solution to our broken United States immigration system, it offers significant benefits that are worth exploring.

Deferred Action for Childhood Arrivals Update

Moving Forward

On September 5th, 2017, the Deferred Action for Childhood Arrivals (DACA) initiative was rescinded by the Trump Administration in a controversial decision. Following and in no small thanks to public backlash and protests, it appears that DACA may still stay afloat. The United States Citizenship and Immigration Services (USCIS) has issued new instructions regarding DACA and its applicants.

Unless another federal decision intervenes, the USCIS has resumed and will continue to accept renewed applications for deferred action through DACA. Anyone who has previously been granted deferred action due to DACA may once again apply to the USCIS. People with previous DACA approvals can reapply even if their deferral request expired on or after September 5th, 2016.

Forms needed for a renewed DACA application include:

  • Form I-821D
  • Form I-765
  • Form I-765 worksheet

The USCIS cannot and will not accept deferred action requests from people who have never been given deferral through DACA. It will also not accept any request for advanced parole from a DACA recipient. Applicants whose last deferral expired before September 5th, 2016 may also not request a DACA renewal. However, they can attempt to re-receive DACA deferral through a new application filing; the key difference being that it will not be considered a renewal request.

DACA deferral is largely based on discretion, the USCIS also warned in its updated instructions. The Department of Homeland Security (DHS) maintains the power to strip DACA deferral at any time and without official notice, rendering a DACA recipient vulnerable to removal actions once again.

(For more information regarding the latest DACA update circa January 2018, you can click here to visit the official USCIS website announcement.)

How to Renew Deferred Action

If your DACA period has expired, you must submit a request to renew.

The steps to renew are as follows:

  • Complete and sign:
  • Follow the instructions on all three forms to submit them to USCIS. Make sure you submit the correct fees.

The United States Citizenship & Immigration Services (USCIS) usually processes renewal requests within 120 days.

    • We highly recommend Atty Robert Milla and Associates.

“We were married in 2009 and got denied the first time it was filed. We got a lawyer to help us and it took years of waiting and nothing came out of it. Until my wife found Atty Robert Milla on the internet and with his very exceptional and successful work on immigration based cases, we decided to asked him to represent us . He told us what documents we need to re submit to follow up the case and waited for a decision. And finally my wife got her green card before Christmas this year exactly 8 years after we first filed it but Atty Robert Milla was able to get it for us , when we thought it was a hopeless case. We are so happy and very grateful for Atty Robert Milla for all the help and understanding and patience to our never ending questions and also to his paralegal Stylvia . Thank you very much. More power.”

“I was so impressed by Robert from the start with my initial consultation - in fact, he answered all of the questions I had brought! In all my work with Robert, he was extremely professional, and took the extra time when he could tell I needed some reassurances. He was always willing to talk through my worries or hypothetical scenarios, and made sure to walk me through each step in great detail. Robert and his team are truly advocates and partners with you. I am so pleased with his outstanding service and he has my greatest endorsement!”

    • The BEST in Chicago Town!

“I met a few lawyers for my Citizenship / N400 filing. My case was complicated and most of the lawyers I met were willing to do it but didn't give me the confidence that will go through. Finally I met Robert, who explained every single detail, chances of approval and course of action in case of a denial and how to proceed. Right then and there, i decided I wanted to go with him....Thank You Robert for all the help and for attending the interview with me...Decision was made in 30 days and I'm waiting to attend the Oath Ceremony now... Thank You!!”

    • The best legal group I've ever had the pleasure of working with in my life.

“Justin Hoefflicker and his team went above and beyond to help us every step of the way. We are a small digital health startup, and without Justin, our company would potentially not be able to continue operations. He helped us secure an H1B visa for our Technical Co-Founder, and went above and beyond through preparation of materials, explaining the process, answering a million follow-up questions (that's an understatement), taking the time to meet and discuss contingencies when he absolutely didn't have to, helping us file a complete Request-for-Evidence (RFE) and not charging us for the additional work, and ultimately, helping us secure the H1B in the end. Even if we hadn't gotten the H1B, I'd still be submitting this review as it's fully merited and Milla & Associates is by far the best legal group I've ever worked with. They're honest, they actually care, they do great legal work at appropriate rates, they actually follow through, they get everything done on time, and they go above and beyond to make sure expectations are set correctly in what can be a very difficult and touchy legal-sphere (immigration). I am extremely grateful for having had the opportunity to work with them, and I wish we had a similar experience with every legal group we had to work with. Thank you Justin and team.”

    • Excellent immigration lawyer!

“I hired attorney Robert Milla to file for my papers here in Chicago. I waited for over 20 years to apply for my green card. Overall, the service was outstanding. He took the time to answer all my questions, he was honest about what to expect and there were no hidden charges for his services. I paid one flat fee for his services and I did not have to pay everything upfront. I recommend him for immigration services and I have recommended one friend and my cousin and they both had the same experience that I did. Result: Application for adjustment of status to permanent resident (“green card”) approved”

    • Best immigration Lawyer

“Robert is very knowledgeable, kind & approachable as well as his staff. From Sylvia to Daniel, they’re always very nice in answering all my concerns. I had no trouble with my USCIS interview because their team made sure that me & my husband were prepared. Robert was highly recommended to me by a Lawyer i know. I’m glad i took her advice and went to seek Roberts assistance regarding my marriage based green card. Got my approval the same day after the interview. I will be getting his assistance with all my immigration concerns including my childrens petition. I highly recommend Robert! He’s the best! 😊👍🏻”

    • Highly recommended!

“My wife and I used Robert Milla as our attorney to file for my wife's green card (through marriage). He was careful, friendly, knowledgeable and attentive (much better than a previous immigration attorney we hired for a different matter). Everything went smoothly with our application and interview, and my wife now has her green card! Highly recommended!”
