Chicago H-1B Visa Lawyer

Helping H-1B Applicants in Chicago & Beyond

H-1B visas are non-immigrant visas that allow skilled, highly educated workers to reside in the United States to help U.S. companies. However, the U.S. has a strict cap on these visas, which currently stands at 85,000 for this year. This total number of visas includes 65,000 new visas available for overseas workers with at least a bachelor’s degree, and 20,000 for workers with advanced degrees from U.S. universities. If you are interested in obtaining an H-1B visa to work in the United States, our H-1B attorneys in Chicago at Milla & Associates, LLC can help.

Who Is Eligible for H-1B Visa?

In order to qualify for a specialty occupation H-1B visa, the job the applicant takes must meet one of the following criteria:

  • Requires a bachelor’s degree or higher
  • The degree required for the occupation is typical for that industry, or the job in question is so specific that it requires that the worker has a certain degree
  • The employer requires a degree for the position
  • The duties of the worker will be so specialized that worker must have experience gained only by one who would have a bachelor’s degree or higher

Eligibility for H-1B visas depends largely on the individual’s education and their field. The H-1B visas were created to support the U.S. economy by allowing skilled workers to enter the United States workforce in specialized fields where experts and professionals are scarce. These specialized fields include IT, finance, accounting, architecture, engineering, mathematics, science, medicine, and other occupations that require in-depth understanding and substantial education.

How Do I Apply for an H-1B Visa?

  • Find an H-1B sponsor. You must find a U.S. employer who is willing to sponsor you into the United States. When applying for the position, be sure to specify that you will require sponsorship to enter the country.
  • If you are hired, your employer must submit a Labor Conditions Approval (LCA). This may be done electronically and is sent to the Department of Labor for approval.
  • When the LCA is approved, your employer must file Form I-219, Petition for a Nonimmigrant Worker. The processing time for this may vary based on the service center that is handling your documents. On average, it may take 3 - 4 months, however, expedited processing is available for an additional fee.
  • When the petition is approved, you can then apply to get your visa processed at your home country’s U.S. embassy or consulate. This may take 2 - 3 days but also varies depending on your location.

How Long Does it Take to Get an H-1B Approved?

The processing time depends on the USCIS. There have been cases where applicants have received approval in as little as 30 days, but others have waited much longer. Because there is a limit as to how many petitions are approved per year, it is advised that employers petition 6 months in advance before the employee starts their job. This allows time for applying again in the event that USCIS rejects the petition.

Premium processing of the I-219 petition is available to employers who are willing to pay an extra $2,500 fee. This guarantees a decision within 15 business days of filing or after responding to a Request for Evidence (RFE).

How Long Does an H-1B Visa Last?

Workers who obtain H-1B visas will hold their visas for up to 3 years and may extend the visa for a maximum of 6 years. Most H-1B visa holders obtain U.S. citizenship during that duration by obtaining their green card. Family members of H-1B visa holders may also receive visas (spouses and children under the age of 21) as dependents, though they may not work in the United States.

Because the number of H-1B visa applicants has been so high, the U.S. has employed a lottery system over the last few years. This means that a computer-generated process helps to fill the visa spots, which are capped at 85,000 visas each year.

  • AMAZING DOWN TO EARTH PROFESSIONAL

“My wife Luiza and I were considering filing our marriage petition on our own, but after careful consideration decided to hire an attorney. We were referred to Robert and could have have been more pleased. It was a stressful time for both of us as our petition progressed, and Robert did an excellent job of explaining the process. Robert was friendly, calming, and knowledgeable. Having worked in the immigration field for over 5 years, I was very impressed with Robert's demeanor and ability to connect with Luiza and I. We could not thank him enough, and will be recommending him to any of our network contacts. Thanks again, Robert! Ben and Luiza”

  • The best legal group I've ever had the pleasure of working with in my life.

“Justin Hoefflicker and his team went above and beyond to help us every step of the way. We are a small digital health startup, and without Justin, our company would potentially not be able to continue operations. He helped us secure an H1B visa for our Technical Co-Founder, and went above and beyond through preparation of materials, explaining the process, answering a million follow-up questions (that's an understatement), taking the time to meet and discuss contingencies when he absolutely didn't have to, helping us file a complete Request-for-Evidence (RFE) and not charging us for the additional work, and ultimately, helping us secure the H1B in the end. Even if we hadn't gotten the H1B, I'd still be submitting this review as it's fully merited and Milla & Associates is by far the best legal group I've ever worked with. They're honest, they actually care, they do great legal work at appropriate rates, they actually follow through, they get everything done on time, and they go above and beyond to make sure expectations are set correctly in what can be a very difficult and touchy legal-sphere (immigration). I am extremely grateful for having had the opportunity to work with them, and I wish we had a similar experience with every legal group we had to work with. Thank you Justin and team.”

  • The Best Lawyer Ever!

“I had problems bringing my wife back to US. Couple different lawyers promised to help but just wasted my money and time. Robert Milla told me upfront what we need to do and finally my wife is back. The Best Lawyer Ever! Result: Hardship waiver application approved (misrepresentation) and immigrant visa granted for permanent resident status (“green card”)”

  • Excellent immigration lawyer!

“I hired attorney Robert Milla to file for my papers here in Chicago. I waited for over 20 years to apply for my green card. Overall, the service was outstanding. He took the time to answer all my questions, he was honest about what to expect and there were no hidden charges for his services. I paid one flat fee for his services and I did not have to pay everything upfront. I recommend him for immigration services and I have recommended one friend and my cousin and they both had the same experience that I did. Result: Application for adjustment of status to permanent resident (“green card”) approved”

  • As of today I am a proud and happy American citizen

“After 4 years of anguish of what will happen with my case I almost had given up. I kept thinking I had ruined it for my kids and we might have to go back. I met Robert when I was almost burned out from all the worries. It felt like meeting an old friend and we had a talk and went through options. He leaves the big words when he works to get the case done, not to show you that he is a great lawyer. But if you trust your heart you will see that you just got lucky stumbling on him. No false promises, I knew all the time where my case was standing and the risks I could face. He thinks ahead and covers all the gaps to get the case done. Later I learned that he actually teaches immigration classes as well but even when he is busy he gets right back to you answering your questions and giving updates. I am very happy I had Robert by my side in my most difficult time and will always keep wishing him well. Thank you Robert you will always have a fond place in our hearts : )”
