Understanding Your Immigration Rights in the U.S.

Although the first two months of the Trump presidency have been filled with confusion and unpredictability, and even hostility toward immigrant communities, one thing is certain - now more than ever it is important to know your rights. Everyone living in the United States has certain rights protected under the United States Constitution, including undocumented immigrants.

The American Immigration Lawyers Association (AILA) is an organization committed to helping immigrants. The attorneys at Milla & Associates, LLC are experienced immigration attorneys and members of AILA, providing comprehensive immigration services, including removal (“deportation”) defense, Deferred Action for Childhood Arrivals (DACA), asylum, U visas, provisional waivers and other hardship waivers, applications for permanent resident status (“green card”), and citizenship.

AILA has created “Know Your Rights” flyers to provide crucial information in the event of an encounter with ICE officers at home, at work, or in a public place. We understand how frightening the thought of an encounter with ICE can be, not to mention an actual encounter. Therefore, it is very important to know how to handle such a situation before it happens.

You do have rights. Please print and read the AILA flyers, and contact Milla & Associates if you want to learn more about your rights and possible eligibility for immigration benefits and relief.

Understanding the Provisional Waiver for Unlawful Presence

March 4, 2013 marked the first day that immigrant visa applicants could file provisional waivers for unlawful presence. Under the prior procedure, individuals had to leave the U.S. before applying for the waiver, thus living abroad (and likely apart) from U.S. citizen family. Although the process just started in March, and we are waiting to see how the system is fully implemented, there is cause for optimism.

  • One of the best Lawyer in Chicago

“I heard about this lawyer from one of my classmate. He was saved from being deported by Mr. Milla and that's when I finalized him to handle my case of filing and getting papers through my spouse. Mr. Milla handled all the paperwork and all I had to do is just sign the papers and my filing was done with such an ease. He was there with us in our interview too and more than myself I trusted his decisions and instincts and I was correct. I was really lucky that my friend recommended him to me and I am sure you will feel the same ones u successfully finish your case with him. Result: Application for adjustment of status to permanent resident (“green card”) approved”

I never met him during the entire stage after our first meeting and he was on point with all the documentation and responsible with communication, and best thing, honest advise. He gave me answers that were right and not what I just wanted to hear and there were multiple occasions where this happened. This honest advice meant everything to us. They are very professional and the way our case went by so smoothly, definitely hats off to the work done by Justin and the team. Would recommend 10/10”

  • Personal immigration lawyer

“Justin is my goto immigration lawyer. I came here as a student and Justin handled my H1B case couple of years ago. Although Trump administration was pushing back on many of the cases with RFEs, Justin gave a strongly worded response back and got me, my H1B. Last year, fortunately I met my now wife and after we got married, Justin handled our green card processing with ease and seamlessly. He has many contacts in the Immigration office, which made even more easier and hospitable for my interview. He was available throughout the interview and even helped on a couple difficult questions in between the interview. Throughout the processing, I found Justin highly organized and great understanding of the domain. He is very current with the news and changes to immigration laws and if he doesn't have answer then, you can expect an email to follow up with answers. I highly recommend Justin as a personal immigration lawyer.”

  • Robert, he was calm, supportive and had a lot of knowledge ...

“My husband applied for my green card and we prepared the documents on our own, but unfortunately I got an RFE for the same documents which we had already submitted. So we thought of hiring a good lawyer for our case, I called up a few lawyers and explained them my case to get 1 free initial consultation, out of the ones we called, I really liked Robert, he was calm, supportive and had a lot of knowledge on such cases. I quickly decided that I would go with him for my case. We met him the next day and discussed our case in detail, soon after we got a list of documents that were needed by his office, we promptly replied, he prepared our case again , we had dew meetings in between and finally my case was approved, He also helped a lot with our interview preparation and also came with us to the interview venue , where he spent more than 2 hours with us explaining the process, he also appeared with us in the interview and was a great support. I finally cleared the interview under his expert guidance. I would definitely recommend him to my friends.”

  • Complicated N400 case!

“I found Milla & Associates through Avvo as he had great ratings and reviews by previous clients. I had a fairly complicated case of immigration for naturalization N400) through a spouse as I had been out of the country for very large chunks of time. Robert was an excellent guide in terms of how to approach the case and what documents to include/exclude in order to make my case stronger. He was thorough with his research and very well acquainted with the whole process. Despite my super complicated case, he put it forward in such a way that it was a smooth approval. He made our immigration journey stress free and having him next to me at my interview made me feel confident since he is very competent! I highly highly recommend him for any immigration law cases”
